 It shall be the policy of the City of Newberry to comply with both the letter and the spirit of the Freedom of Information Act, as codified at §§ 30-4-10 et seq. of the Code of Laws of South Carolina 1976, as amended, in regards to the processing of requests for access to public records. 

All requests for public documents pursuant to FOIA, except for those outlined in the code, must be made in writing, and preferably submitted via email to the Municipal Clerk at This email address is being protected from spambots. You need JavaScript enabled to view it.. Requests may be delivered in person at Newberry City Hall, 1330 College Street, Newberry, SC 29108; by mail to City of Newberry, Attn: Municipal Clerk, P.O. Box 538, Newberry, SC 29108; or by fax to 803.321.1003. Ideally, requests shall be made using the Freedom of Information Act Request Form. Requests made by letter or in some other written form shall contain substantially the same information provided for on the Request Form. In order to ensure the most accurate and prompt response, requests should be as detailed, specific, and descriptive as possible.   

 Requests to inspect the following public records need not be in writing, provided the requestor appears at the Municipal Clerk’s office in-person and within normal City business hours:

  1. Minutes of all public meetings of the City for the preceding (6) six months; and
  2. Reports from the preceding fourteen (14) days which disclose the nature, substance, and location of any crime or alleged crime reported as having been committed (with the exception of records regarding juveniles); and
  3. Documents identifying persons confined in any jail, detention center, or prison for the preceding (3) three months (with the exception of records regarding juveniles); and
  4. Documents produced by the public body or its agent that were distributed to or reviewed by a member of the public body during a public meeting for the preceding six‑month period.

The City’s agendas and minutes shall be posted on the City website free of charge.

As required by FOIA, the City staff must respond to all FOIA requests for records which are less than two years of age within 10 business days (excluding Saturdays, Sundays and legal holidays) of receipt of the request and produce the requested information within 30 calendar days of the later of either the City’s notification as to the availability of the requested public record or the date an advance deposit is made if required by the City.

 City staff must respond to all FOIA requests for records which are more than two years of age within 20 business days (excluding Saturdays, Sundays and legal holidays) of receipt of the request and produce the requested information within 35 calendar days of the later of either the City’s notification as to the availability of the requested public record or the date an advance deposit is made if required by the City.
